The Point of Order is not well taken. The Councilor from Delta had an opportunity to present further amendments during the more than 72 hour period after the disposition of her last amendment. It is now out of order to present amendments and the Council will proceed with voting.

Are there any Councilors who wish to vote or to change their vote? If not, on this vote the Yeas are 1 and the Nays are 1. The Council being equally divided, the Chair casts the deciding vote in the affirmative, so the resolution is adopted.

Objection. The right of the chair to break ties is defined by the bill being voted on. One cannot use a feature of a bill to pass a bill. Thus, the bill did not achieve a majority, and should be judged as failed.

After consulting with the Parliamentarian, it is the custom of the Council that ties may be broken by the Presiding Officer. Therefore, the point of order is not well taken and the resolution is agreed to.
